Campaign Terms

These Campaign Terms apply when you back a campaign on kingofamericastudio.com (the "Site") run by Gravir Holdings LLC, a Texas limited liability company owned by Cory Myres ("we," "us," or "our"). They are part of our Terms of Service. Each campaign page also states that campaign's goal, deadline, funding method, charge dates, reward tiers, and refund rules. If a campaign page differs from these Campaign Terms, the campaign page controls for that campaign.

1. What backing a campaign is

• A purchase or business contribution. Backing a campaign is a purchase from, or a business contribution to, a Gravir Holdings LLC venture.
• Not a donation. Gravir Holdings LLC is a for-profit business, not a charity. Nothing you pay is a charitable donation, and nothing is tax-deductible.
• Not an investment. Backing is not an investment or a security. You receive no ownership, equity, shares, loan, interest, profit share, revenue share, or other financial return, and no right to vote on or direct the project.
• No intellectual property. Designs, drawings, 3D models, software, names, logos, photos, video, and all other intellectual property created for a campaign belong to Gravir Holdings LLC or Cory Myres. Backing gives you no rights in them.
• Prototypes and materials stay with us. Prototypes, test builds, tools, shop equipment, parts, and build materials bought or made with campaign funds remain the property of Gravir Holdings LLC or Cory Myres. Backers receive the rewards listed for their tier, not any part of the project itself.

2. Reward tiers

Every campaign offers fixed reward tiers. Every backer at a tier receives the same reward, as described on the campaign page. There are no prizes, drawings, chances, or random selection of any kind. Where a tier comes with a number or place in line, it is assigned by the order in which backers commit, never by chance.

3. Ways to back a campaign

A campaign page states which of these methods it uses.

All-or-nothing pledge. When you pledge, our payment processor, Stripe, saves your card. You are not charged when you pledge. If the campaign reaches its goal by its deadline, you authorize us to charge the full pledged amount to your saved card during the charge window stated on the campaign page. If the goal is not reached, you are never charged. Unless the campaign page says otherwise, Give Now contributions count toward the goal. You may cancel a pledge before the deadline through our contact form.

Give Now. A Give Now contribution is charged immediately, carries no reward unless the campaign page says otherwise, and is kept and used for the project even if the goal is not met. Give Now contributions are not refundable, except for a duplicate or unauthorized charge or as required by law.

Pre-order. A pre-order is charged when you place it. If the campaign has a goal and the goal is not met by the deadline, every pre-order is refunded in full to the original payment method within 7 business days after the deadline. You may cancel a pre-order for a full refund until the order window closes.

Deposit. Some tiers, such as a Build Slot, are deposits that reserve the opportunity to buy a finished product later. Unless the campaign page says otherwise:

• the full deposit is credited toward your invoice for that product;
• you may get a full refund of the deposit on request, at any time until you sign that invoice;
• if we do not offer you the product, we refund the deposit in full;
• deposits are stackable: you may combine a deposit with other reward tiers in the same campaign, or hold more than one deposit where the campaign allows, and each deposit is credited in full to the invoice for the product it reserves; and
• a deposit is not a contract to buy the product and does not lock in a price, specifications, or delivery date. Those are set in the invoice we offer you, which you may accept or decline. If you decline, we refund the deposit in full.

If a deposit tier also includes other rewards, those rewards are yours to keep even if your deposit is refunded.

4. Card authorization and failed charges

By pledging, you authorize Gravir Holdings LLC to charge your saved card, without further action from you, for the pledged amount if the campaign is funded. Keep your card details current. If the charge is declined, we will contact you by email and give you at least 7 days to provide a working payment method. If payment still cannot be collected, we may cancel your pledge and any reward or reserved place that came with it. Your pledge does not count as paid until the charge succeeds.

5. Refunds

• Pledges are only charged if the campaign is funded, so there is nothing to refund if it is not.
• Pre-orders are refunded in full if the goal is missed or we cannot fulfill them.
• Deposits are refundable as described in section 3.
• Give Now contributions are not refundable, except as stated in section 3.
• Undeliverable or reduced rewards. If we cannot deliver a reward, or must change it in a way that materially reduces what you receive, we will offer you a refund of the amount you paid for that reward.
• Damaged or defective rewards. Physical rewards that arrive damaged, defective, or wrong are covered by our Refunds & Returns policy, including its 30-day reporting window.
• How refunds are paid. Refunds go to the original payment method, usually within 7 business days after we approve them. Your bank may take longer to post them.

6. Delivery estimates and delays

Campaign timelines and delivery dates are good-faith estimates based on our plans when the campaign launches. They are not guarantees. Building things involves real risk of delay. We post progress updates on the campaign page and email backers at major milestones.

For pre-orders and other items we have charged you for, if we learn we cannot ship by the date we stated, we will promptly email you with a revised shipping date, or tell you we do not have one yet, and give you the choice to cancel for a full refund. If we cannot ship at all, we will cancel the order and refund you without being asked.

7. Shipping and taxes

• Where we ship. Rewards and pre-orders ship to U.S. addresses only.
• Shipping costs. Unless the campaign page says otherwise, U.S. shipping is included in the tier or pre-order price.
• Shipping address. For pledges, we collect your shipping address by email after the campaign is funded. Please reply by the date in that email. If you give us a wrong address or do not reply, we are not responsible for a lost or late reward, and re-shipping may cost extra.
• Taxes. Tier and pre-order amounts include any Texas state and local sales and use tax that applies; we do not add tax on top. Tax on a product reserved with a deposit is calculated on its final invoice.
• Large items. Delivery or pickup of large items, such as vehicles, is arranged and priced on the product's invoice.

8. Changes to rewards and campaigns

We may make reasonable changes to a reward, such as color, material, size, or supplier, or substitute a reward of equal or greater value. If a change materially reduces what you receive, we will offer you a refund for that reward. We may extend a campaign's timeline, but we will not move an all-or-nothing deadline or change a goal after you pledge without giving you the chance to cancel. We may cancel a campaign before its deadline. If we do, no pledges are charged, and all pre-orders and deposits are refunded in full.

9. Recognition and backer names

Some tiers include public recognition, such as a name on a backers' wall. We will display the name you give us for that purpose. You may ask us, through our contact form, to use a different name, your initials, or "Anonymous," or to remove it.

10. Vehicles, equipment, and physical builds

Vehicles, equipment, and other physical builds can cause injury or property damage. Unless we state otherwise in writing:

• they are built for off-road, recreational use on private property;
• they are not street-legal, registered, titled, or certified to any federal or state vehicle safety standard; and
• they are not designed, tested, or intended for use by children.

Anyone who uses one is responsible for following all instructions and warnings, wearing appropriate protective gear, and complying with all laws, permits, and property rules that apply where it is used. You use such products at your own risk, to the extent the law allows. Scale models, challenge coins, and similar collectibles are display items for adults, not toys.

11. Our responsibility

We are a small business running our own campaigns. We will use our funds for the project described, keep backers informed, and treat backers fairly. The disclaimers, limitation of liability, indemnity, governing law (Texas), and venue (Travis County, Texas) sections of our Terms of Service apply to every campaign. Nothing in these Campaign Terms limits any right you have under Texas or federal law that cannot be waived.
