Terms of Service
Effective date: October 20, 2026
These Terms of Service (the "Terms") are an agreement between you and Gravir Holdings LLC, a Texas limited liability company owned by Cory Myres ("King of America," "we," "us," or "our"). They govern your use of kingofamericastudio.com (the "Site"), our store, project funding pages, email list, content, and any services booked or bought through the Site. Our Campaign Terms and our Refunds & Returns policy are part of these Terms.
1. Acceptance of these Terms
By using the Site, making a purchase, backing a project, or booking a service, you agree to these Terms, our Campaign Terms, our Refunds & Returns policy, and our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old, or the age of majority where you live, to make a purchase, back a project, or book a service.
2. Use of the Site
You may use the Site for lawful, personal, non-commercial purposes. You agree not to:
- break any law or infringe anyone's rights while using the Site;
- interfere with or disrupt the Site, its security, or its checkout, forms, or hosting;
- submit false information, spam, or automated form submissions;
- scrape, copy, or harvest content or data from the Site by automated means, except as allowed by standard search engines; or
- attempt to gain unauthorized access to any part of the Site or the systems behind it.
3. Intellectual property
The Site and its content, including our names, logos, seals, mottos, and other marks, product designs, artwork, photos, videos, text, courses, downloads, and other digital content, are owned by or licensed to Gravir Holdings LLC and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable license to view the Site and to use any digital content you buy or download for your own personal use, unless we state a different license when you get it. You may not copy, share, resell, reproduce, or create products from our designs, marks, or content without our written permission. Buying a physical product gives you ownership of that item, not the right to reproduce its design.
4. Your submissions
The Site does not host public user content. If you send us messages, information for a service, ideas, or feedback, you confirm you have the right to share them, and you allow us to use feedback and ideas to improve our products and services without owing you anything. We will treat personal information in your submissions as described in our Privacy Policy.
5. Store purchases
Products. We may offer physical products (such as apparel, wall art, gifts, and other goods), digital products (such as downloads, files, and media), and pre-orders. Product descriptions, images, and specifications are provided in good faith, but colors and details may vary slightly from what you see on screen.
Orders and pricing. All prices are in U.S. dollars. Prices, products, and availability may change at any time. Applicable taxes and shipping charges are shown at checkout. An order is accepted only when we confirm it; we may refuse or cancel an order, including for suspected fraud or an obvious pricing or listing error, and we will refund any amount charged for a cancelled order.
Payment. Payments are processed by our third-party payment processor. By checking out, you authorize the charge for your order and agree to the processor's terms.
Shipping and fulfillment. Some physical products are made to order by fulfillment partners. We ship only to the locations offered at checkout. Shipping and delivery times are estimates, not guarantees, and packaging may vary by fulfillment partner. Title and risk of loss pass to you when the item is handed to the carrier.
Pre-orders. Pre-ordered items ship when they become available. Estimated dates may change, and we will keep you informed. If we cannot fulfill a pre-order, we will refund what you paid for it.
Returns and refunds. Because many items are made to order, we do not accept returns or exchanges for change of mind or wrong size choice. If an item arrives damaged, defective, or misprinted, or is the wrong item, contact us through our contact form within 30 days of delivery and we will send a replacement or issue a refund at our choice. Digital products are final once delivered or accessed, unless a file is defective and we cannot fix it. Full details are in our Refunds & Returns policy.
Nothing in this section limits any rights you have under applicable law that cannot be waived.
6. Backing a project
What backing is. We may seek funding on the Site for products and projects of any kind, including vehicles and other builds, merchandise, books and media, courses, and other physical or digital products. Backing a project is a purchase from, or business contribution to, a Gravir Holdings LLC venture. It is not a charitable donation, is not tax-deductible, and is not an investment. It does not give you any ownership, equity, profit share, financial return, or intellectual property rights.
Each campaign's terms control. Every campaign page states its goal, deadline, funding method (such as all-or-nothing pledges, Give Now contributions, pre-orders, or deposits), when you will be charged, its reward tiers, and its refund rules. Those campaign-page terms and our Campaign Terms are part of your agreement with us for that campaign. If they differ from this section, the campaign page and Campaign Terms control.
Pledges. An all-or-nothing pledge saves your card and authorizes us to charge the pledged amount only if the campaign reaches its goal by its deadline, within the charge window stated on the campaign page. If the goal is not reached, you are not charged. You may cancel a pledge before the deadline through our contact form.
Charged-now payments. Some campaigns charge you when you back them. Whether that payment is refundable depends on the campaign. A Give Now contribution is kept and used for the project even if the goal is missed. A pre-order charged at the time of order is refunded in full if the campaign's goal is missed or we cannot fulfill it, as stated on the campaign page.
Deposits. Some reward tiers, such as a Build Slot, are deposits that reserve the chance to buy a finished product later. Unless the campaign page says otherwise: the full deposit is credited toward your invoice for that product; you may get a full refund on request at any time until you sign that invoice; and if we do not offer you the product, we refund the deposit in full. Deposits are stackable: you may combine a deposit with other reward tiers in the same campaign, or hold more than one deposit where the campaign allows, and each deposit is credited in full to the invoice for the product it reserves. A deposit is not a contract to buy the product and does not lock in a price, specifications, or delivery date unless the campaign page says so; those are set on the invoice you choose whether to sign.
Rewards and delivery. Rewards are delivered after the campaign is funded and the reward is produced. Delivery dates are good-faith estimates, not guarantees. We may make reasonable changes to a reward or substitute one of equal or greater value. If we cannot deliver a reward, or must change it in a way that materially reduces what you receive, we will offer you a refund of the amount you paid for that reward.
7. Safe and lawful use of products
Some products or rewards, such as vehicles, equipment, or other physical builds, may involve risk of injury or property damage when used. Unless we confirm otherwise in writing, we do not represent that any product is approved, registered, licensed, or legal for use on public roads or in any particular place. You are responsible for following all instructions and warnings, using appropriate protective gear, supervising minors, and complying with all laws, registrations, and permits that apply where you use the product. You use such products at your own risk.
8. Services
We may offer paid services such as advice sessions, consulting, coaching, courses, and similar offerings, booked and paid through third-party scheduling and payment providers. Payment is taken when you book unless we state otherwise. To reschedule or cancel a scheduled session, give at least 24 hours' notice; late cancellations and missed sessions are non-refundable. Longer engagements may be governed by a separate written agreement that sets the scope, timeline, and fee; if that agreement conflicts with these Terms, the agreement controls.
Our services, courses, and content provide general information and perspective based on experience. They are not legal, tax, accounting, investment, or other licensed professional advice, and no professional-client relationship is created. You are responsible for your own decisions and for consulting qualified professionals where needed.
9. Third-party services
The Site relies on third-party services, such as hosting, payment, fulfillment, scheduling, email, and video providers. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services or content we do not control.
10. Disclaimers
THE SITE, ITS CONTENT, AND OUR PRODUCTS, PROJECTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN THESE TERMS. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PROJECT WILL BE FUNDED OR COMPLETED ON SCHEDULE. Blog posts and other content express opinions and are for general information and entertainment only.
11. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, GRAVIR HOLDINGS LLC, CORY MYRES, AND OUR MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SITE, OUR PRODUCTS, PROJECTS, OR SERVICES, OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR $100. These limits do not apply where the law does not allow them, including liability for gross negligence, willful misconduct, or fraud.
12. Indemnity
You agree to defend, indemnify, and hold harmless Gravir Holdings LLC, Cory Myres, and our members, employees, and agents from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your use or misuse of the Site, products, or rewards, or your violation of any law or the rights of others.
13. Termination
We may suspend or end your access to the Site, cancel orders, pledges, or bookings, or refuse service at any time if we reasonably believe you have violated these Terms or the law, or to prevent fraud or harm. If we cancel something you paid for and you were not at fault, we will refund the amount paid for it. Sections that by their nature should survive, including intellectual property, safe and lawful use, disclaimers, limitation of liability, indemnity, and governing law, survive termination.
14. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we consent to the personal jurisdiction of those courts. Before filing a claim, you agree to contact us through our contact form and give us 30 days to try to resolve it informally.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. Changes apply to use of the Site after they are posted and will not change the terms of an order, pledge, deposit, or booking you made before the change. If you keep using the Site after a change, you accept the updated Terms.
16. General
These Terms, our Campaign Terms, our Refunds & Returns policy, our Privacy Policy, the terms on any campaign page, and any separate written agreement for a service are the entire agreement between you and us about the Site. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a sale or reorganization of our business.
17. Contact us
Questions about these Terms can be sent to Gravir Holdings LLC through the contact form on our Contact page.
